CSi Prevails Over Ashlar In Court

Fort Worth, TX —Judge Lee Yeakel of the United States District Court for the Western District of Texas has denied Ashlar’s application for a preliminary injunction filed against CSi. Judge Yeakel ruled in favor of CSi because Ashlar had failed to establish a likelihood of success on the merits of its intellectual property infringement case. Judge Yeakel’s decision occurred immediately after hearing oral arguments and testimony from CSi and Ashlar that included discussions of the contracts and licenses between the two parties. In his ruling, Judge Yeakel also found that Ashlar had failed to convince the Court to its claims of intellectual property ownership.

The Court also heard testimony regarding CSi’s assertion that Ashlar’s license to use CSi software in products marketed by Ashlar has terminated. Ashlar’s president confirmed that Ashlar purposefully decided not to pay the fees necessary to maintain the license, that Ashlar received notice of its failure to pay, and that Ashlar did not fix this default within the period necessary to avoid termination of the license.
